Delayed payments are one of the biggest challenges faced by Micro, Small and Medium Enterprises (MSMEs) in India. When payments remain unpaid for months, businesses struggle with working capital, salaries, GST compliance, vendor payments, and day-to-day operations. Although the MSMED Act, 2006 provides protection to MSMEs against delayed payments, conventional dispute resolution often involves lengthy legal proceedings. To make dispute resolution faster, affordable, and technology-driven, the Government of India has introduced the MSME Online Dispute Resolution (ODR) Portal โ€” a digital platform that integrates online mediation, arbitration, AI-assisted negotiation, and the Micro and Small Enterprises Facilitation Councils (MSEFCs).

Scheme Objectives

1
Develop an Online Dispute Resolution mechanism for all States and Union Territories to address delayed payments faced by Micro and Small Enterprises.
2
Promote digitization and digitalization and ensure uniformity and standardisation in the dispute resolution mechanism.
3
Ensure speedier and cost-effective dispute resolution for MSMEs to enhance financial strength and competitiveness of these enterprises.
4
Promote containment of disputes through negotiation and mediation to make the dispute resolution process less adversarial.
5
Ensure ease of access to justice for Micro and Small Enterprises and to reduce delays in resolution of disputes.
6
Make justice accessible to MSMEs in a vernacular language, thus making the processes more comprehensible.
7
Facilitate ease of administration of justice by increasing awareness about the legal rights of Micro and Small Enterprises. MSMEs registered on Udyam (UR) or Udyam Assist Platform (UAP) are eligible to file.

Legal Framework Governing MSME ODR

โฐ
Key Provision โ€” MSMED Act

45-Day Maximum Credit Period

Even where parties agree on a credit period, it cannot exceed 45 days from the date of acceptance or deemed acceptance of goods or services under the MSMED Act. If payment is delayed beyond this limit, the Act provides for interest on delayed payments. The Facilitation Council provides a mechanism for resolving such disputes through conciliation and arbitration.
